KWPD Releases Additional Information on Zuelch Accident

I strive to be accurate.  In fact, some have suggested I am dishonest here on my blog.  Yet when I challenge them to find ONE instance of my being dishonest, or even inaccurate, all they can resort to is calling me names.  Essentially they just don't like the facts about which I chose to write.  You might notice historically I prefer to quote from emailed responses, and as often as possible link to supporting documents.

And I'm sorry if so many taxpayer funded media and public relations people don't appreciate me trying to pry public records from their resistant hands, but perhaps if their first concern was transparency versus public relations, it wouldn't prove so painful.

To that end, Alyson Crean of KWPD has released additional documents pertaining to Deputy Zuelch's accident.  To be quite clear I asked for "any reports" and Alyson Crean provided to me what she termed the "final report."  She now has released additional information.  Unfortunately, what she released contained some items that I know should have been redacted, and in an abundance of caution I will not provide them here.

But I will discuss those details released:

First, Zuelch unlocked her phone and let the investigators review the call and text history, and additionally provided a call log that illustrated she was not on her phone or texting at the time of the accident.

Additionally one witness stated "Shocked, I too did not really notice him until he was struck, all was accident."  Another fourteen year old witness said, "Person stepped out of trees. He walked out into street.  The Officer slammed on the brakes and tried to stop."

KWPD also immediately secured the in-car video and worked with MCSO IT to download an unaltered copy.

Also though, Zuelch lawyered up, and made no statements, referring investigators to her attorney.  I completely understand that in today's world.

While KWPD made extenuating effort to obtain the BAC of the guy that was hit including trying to obtain a subpoena through the State Attorney's Office, from what I can see they made no effort to obtain Zuelch's BAC, even a voluntary request.

The report also states;

"No brake shadow present before area of impact"
"area of impact to brake shadow 55' 10"
"area of impact to crosswalk 34'00" "

This tells me that while the pedestrian was 34 feet in front of a crosswalk, that Deputy Zuelch hit the pedestrian and continued through the crosswalk and beyond for 21' until she applied her brakes.

I give all the benefit of the doubt in this case to Zuelch, even though it took her approximately 1.5 seconds to hit her brakes.

But still I can hear some of you out there that aren't enamored with Naked Conch saying... "So Gardi, why don't you keep your big mouth shut until you have all the facts?"

That's my point exactly.  First, I still don't have all the facts.  I don't know conclusively if Deputy Zuelch was under the influence of  any substance.  That could have been resolved by KWPD requesting a test.  If Zuelch wants to lawyer up, fine.  But not seeing someone very close to a crosswalk, and not braking for 55 feet after hitting them to me is probable cause for a toxicology test.  Let her lawyer, the State Attorney and/or a Judge decide later that it isn't.  But I have spoken to other Law Enforcement Officers that have said they would volunteer one immediately in the interest of clearing their name.

More importantly, MCSO could have exercised their existing personnel policy and taken a test and put any such doubt to bed, but they chose not to.  Again, that's my point.   This isn't about Zuelch, or this tragic accident, but it's about the decisions that are made by Agency Admin in these instances that give the appearance of preferential treatment and ultimately create doubt.  There is no need for anyone to have such doubt, at all.

Also, while not texting, how do we know she wasn't distracted by something else like a laptop in her car?  We don't, as far as what I can see at this point.  How do we ever correct what might be job related expectations that distract Law Enforcement Personnel if the choice of administrators is to sweep things like this under the rug to avoid public criticism, versus addressing it head on.  Colonel Ramsay went so far as to make adjustments in policy after Deputy Powers was killed in an accident, but chose not to use existing policy to conduct a toxicology test on Zuelch or Deputy Ward after they were involved in accidents resulting in fatalities.  There is no excuse for that.  If they want to work for MCSO, they know the drill, make the tests mandatory as Tom Peteck would do.  Not doing so allows for, or creates the impression of favoritism....and a public that feels like there is a double standard.

Further, I didn't have ALL the facts because of the way media relations personnel circle the wagons.  Sorry, I'm not your average Keys reporter influenced by advertising in my paper.  I'm sorry I don't want to just regurgitate agency press releases and that I want to understand and convey the full extent of what has happened.  The idea is to keep the public informed and promote improvements.  Those responsible for interacting with the press need to accept that there is a vast and viable spectrum of alternative sources from which the public glean their news from, and need to be as transparent as possible in all cases.

After taking the full 60 day maximum time allotted to complete a very detailed (Two paragraph narrative) investigation, KWPD released the "final" report of the unfortunate accident in which Deputy Zuelch was involved in back in August. (When she struck a pedestrian with her patrol car in Key West.)

I want to stress that I am VERY pro law enforcement.  But when the public is given the impression that there is any preferential treatment given to a law enforcement officer, the reputation of ALL law enforcement is diminished and compromised.  For that reason alone, law enforcement officers should be held to at least the same standard you or I would be.  This is not a "circle the wagons" event, this is a "do above the right thing" event.  Do I think Deputy Zuelch was DUI?  No.  But can we be sure?  No, only because of the way this was handled.  There is no reason for the public to have any doubt about whether she was DUI or distracted by texting, but unfortunately...we are unsure.

How comprehensive is this investigation?

Recent public debate regarding the costly study to widen the harbor channel leading into Key West has stirred up many lines of reasoning.  Barely visible in the proponents' silty cloud of verbal discharge was this turd articulated by Key West Mayor Craig Cates.  (Someone should inspect the lock on his Y valve.)

According to an article in the Citizen (See  Here),  Cates stated, "I am in favor of doing the study if it doesn't cost the taxpayers any money," and "I don't see a down side if it doesn't cost us anything."

Folks, I'm not really an "I told you so" type of guy. ;)  OK, OK, yes, I am and this one takes the cake.  Our esteemed daily, the Citizen is heaping accolades upon the Key West City Commission today for their epiphany about recycling.  (See Here)  Give me a break.

Three and a half years ago I penned a piece on the front page of Key West the Newspaper about this obvious problem.  (See Here) Yes, that was February 13, 2009 within which I stated the following about Waste Management;
...they get paid per ton of trash they haul, and they incur additional costs if they actually collect the recyclable material.  Their incentive is to haul trash, and enjoy a low recycling rate regardless of whatever pretty PR they push…and it all gets back to their contract with the City.

Trimming Back the Tree Commission

Citizen Acknowledges Down's Fight

Today's Citizen ran an article about community activist Sandra Down's open challenge to the City of Key West regarding reigning in the City's Tree Commission.  Downs, who has been on a crusade to inform the public of just exactly how the City Tree Commission has been functioning, was recently fined $5,000 for removing a tree for a customer in an emergency situation, with a permit pending as per regulation.

Downs argues that the Tree Commission has become a revenue raising arm of City government that has over stepped it's bounds and authority, and she is calling on City officials to reign them in.  Of note is the fact that public record of the meeting in which Downs was fined has seemingly been deleted or destroyed, adding fuel to the fire.  For detailed coverage of the entire story, blogger Sloan Bashinski has been covering the events in detail at http://goodmorningkeywest.com/.   I would do the entire story injustice if I tried to summarize the detail with which Bashinski has been covering it, I recommend you take a look.

The most glaring truth in today's Key West Citizen's article was this little gem...

Some local landscapers said they agree with Downs' assessments but would not speak for attribution, citing fears of reprisal from city officials.

Folks, when people are afraid of their government to the point that they fear retribution that can affect their livelihood, we have a real problem.  All City Officials should be concerned and consider Down's claims with the utmost of seriousness.  Regardless of the outcome of any appeal, or the validity of any particular fine, when public records get destroyed and the general public fears retribution from the long arm of government...Houston, we have a problem!

He's been compared to Christ (By Sloan Bashinsky), but many throughout our community consider him the devil.  He might have the City of Key West on the ropes for another "Duck Tours" type of lawsuit, and he has been covered in just about every blog and newspaper in the Florida Keys, including most recently in the Key West Citizen.

Robert Krutko is scheduled to appear this Friday, January 27 at Noon on the Naked Conch Hour on KONK broadcasting.  Krutko's story has more twists and turns than a channel in the Mud Key mangroves, and is a story that is easy to get lost in.  But now, this Friday, Krutko tells his side in person on the Naked Conch Hour...or as in person as he can get with a Florida arrest warrant hanging over his head.

That's right, Krutko will be appearing by phone from Ohio and we'll be discussing whether that arrest warrant is justified, or whether Krutko is a victim of a corrupt system, hell bent on destroying him while he fights for justice.  We will examine the merits of his lawsuit, the potential theft of his charter boat, and the subsequent legal challenges Krutko faces.  This won't be a free ride for Krutko to simply state his side of the story, we plan to place him in the "hot seat" and see if he stands tall.

A Conundrum for David Fernandez

This would appear to be a City sidewalk.  One that seems to be graced with some art, expression or..."graffiti?!?"

First let me go on the record to state that I wish no ill will towards this establishment.  Further I would encourage this type of character and expression if I was a City leader.  Within reason of course.  It creates character, and differentiates Key West from Podunk, Iowa.  It's what attracts visitors.  We also all know that this type of expression exists all over Key West, and it's a good thing.

But it is just that "within reason" part, where City officials have the ability to exercise discretion in how they handle such instances as this...and the Virginia Street wall.  In this instance, if I were a City official, and if it is found to be that the restaurant has painted this, and it is indeed an infraction of City ordinances, I would politely ask them to remove it at their expense.  I would suggest that if they would like to express such creativity that they petition the appropriate channels for a variance to do so.  Just as with the Virginia Street wall, reason would dictate that the the issue would have been resolved in a few short days when the wall was to be torn down.

But in the instance of the Virginia Street wall, Assistant City Manager David Fernandez had a little pow wow with City Manager Jim Scholl and chose to live by the letter of the law twisted to the extreme for their bizarre rationalization defending their actions.  They deviated from "reason" and chose to expend City resources to paint a wall that would be torn down.  They chose to vindictively have those that painted the wall cited with misdemeanors of Criminal Mischief.

So there it is.  Does Fernandez have a little conference with Scholl, send in a City crew with pressure washers, have Key West Police document the damages, and then ultimately cite those who painted this on a City sidewalk with Criminal Mischief?

Or will Fernandez conclusively prove that he was selectively enforcing City ordinances in the case of the Virginia Street wall?

Or will he do us all a favor, issue a public apology, resign, and leave Sweet Tea's alone?

I hate being late to a good party, seems like you always miss something.  But that is how I feel right now having recently found out that Key West just burned through a cool $236,000 placing new grass on City baseball and softball fields.  That's grass.  As in sod...stuff you step on.  To make matters worse, expensive sod requires lots of water to protect the investment.  Water is expensive, and something we are supposed to be trying to conserve.  Well watered expensive grass requires frequent mowing and meticulous care.

How did I miss the fact that we were suffering from such inadequate grass?  I missed the headline that read "Yet Another Ten Year Old Shortstop Tragically Loses Incisor to Bad Hop Caused by Dastardly Dandelion."  No, not one sane person can even try to give me the "it's all about the children" teary eyed speech over this one.  Not when we hear rhetoric at a recent City Commission meeting about trying to find creative ways to cover the over $6 Million dollars we owe to FEMA because of some other previous stooge type blunder by City leaders.

Who could have imagined Republican Senator John McCain joining forces with President Obama to pass legislation whereby our government can now detain any American anywhere without due process?

Well I guess I could have, as I have stated before that at a national level our two party system has joined forces to usurp the power of the people and to destroy any last vestiges of our Constitution.

Of note also is the fact that Republican Senator Rand Paul, and Independent Senator Bernie Sanders (arguably the most liberal Senator) joined forces standing with the 13 Senators in opposition of this tyrannical piece of legislation.

So what is the real deal with the outcry over the Virginia Street wall fiasco that has gone on in Key West recently. This isn't about an ADA compliant sidewalk, nor is it about the destruction of the character of Key West.  It isn't about the waste of federal tax dollars we don’t have, and no, it’s not about the City sidestepping HARC and barreling through a project without their approval as any other peon would have had to have done.

Virginia Street is about an overbearing government that wants to oppress opposing opinions. Virginia Street is about free speech. Virginia Street is about what differentiates us from banana republics, and totalitarian regimes. It’s about cowboy government officials that want not only to silence, but want to penalize those residents that might not agree with them. For those that may have somehow missed this latest debacle of Keystone Cop City Officials at their best, here is a summary.


State Attorney Dennis Ward Not Inclined to Prosecute Virginia Street Wall Artists

In a brief conversation today with State Attorney Dennis Ward, he stated that after reading initial news reports and reviewing Key West Police Department Incident Reports that the Office of the State Attorney did not currently have the inclination to prosecute those charged with painting the Virginia Street wall scheduled for demolition.

The charges, violations of state statutes that rise to the level needed for prosecution, were levied by Key West Police Department, apparently at the behest of City officials, against artist who expressed disdain at the wall's proposed demolition.  The wall, which had been built by the property owner on the City right-of-way decades ago, is questionably the property of the home owner when one considers the State of Florida's Adverse Possession laws.  It has not yet truly been determined which City officials orchestrated this "Nazi-esque" exhibition of government gone wild, but rest assured this is one shell Naked Conch plans to expose!

Ward expressed his reservation of wasting continued public resources on the issue, but will make a final determination in the short term after consulting Chief Assistant State Attorney Manny Madruga and Chief Investigator Mark Wilson.

Ward deserves a big thumbs up for this sentiment, and his defense of freedom of speech.

The Citizen is reporting the tragedy of Key West City Officials painting over views expressed on a wall slated to be torn down to complete the silly project on Virginia Street...and giving out citations as Christmas presents!  (Read about it here in the Citizen)  This project is a waste of fiscal stimulus funds, a destruction of the character of Key West, and now we have this abuse!


Readers Overwhelmingly Oppose Dredging Survey

The results of our month long online poll are in, and while not scientific, they are clearly revealing.

After our Dredging for Dummies post we offered readers the opportunity to provide their opinion of the proposed study by participating in a poll that asked:

DO YOU SUPPORT KEY WEST PURSUING A $5.5 MILLION DOLLAR STUDY TO WIDEN THE HARBOR CHANNEL?

The results suggest that the vast majority of respondents are overwhelmingly opposed to the study as seen below.

We hope this puts a nail in the coffin of that scattered brain idea once and for all.

Kudos to Yaniz

Here's a big shout out to newly elected Key West City Commissioner Tony Yaniz for working to drive the last nail in the coffin of the channel widening debate.  The widening issue, which by the way, according to an ongoing  poll on this blog, is failing by almost a 4 to 1 margin.

According to the Key West Citizen, Yaniz will be working on a resolution to propose that the City's position is to put this dog to bed and not pursue it any further.

From the Citizen article...
"I am not anti-cruise ship," Yaniz said. "They provide some money to the city. I am anti-widening of the channel. It is obvious that the large majority of the citizens of this island do not want the widening of the channel. They are now starting to see through the smokescreen that was thrown out there."
I have written often about milk toast politicians, who won't take a stand or will ride the fence in order not to offend anyone.  I have argued that true leadership is doing what is right and fighting for it.  After this last effort to put a referendum item on the City ballot, which might have been OK aside from the fact that it was vague and open ended and made no reference to the potential costs, Yaniz is right to lead the way to put an end to the debate once and for all.

Dredging for Dummies


For those of you that read my columns with any frequency, you might have a sneaking suspicion that I’m not the greatest fan of government waste. The mere fact that any government entity is even considering a five million dollar feasibility study to dredge the cut coming into Key West harbor has me oscillating between laughing and crying. Laughing because it is clearly fodder for a John Stewart segment, and crying because I know government is just stupid enough to do it.

First, let’s put all those “if you don’t support dredging the channel you are anti-business” arguments to bed. Quite the contrary. Many of the opponents of this proposed five million dollar displacement of our tax dollars are business owners themselves, and recognize the need for a diverse economic base. It’s that word diverse that I would like to stress, a word that characterizes a healthy, sustainable economic base.

Let’s take a look at the rationale behind this disastrous determination to dig. The argument is that the cruise ship industry is moving towards larger ships, and that current sections of the channel leading into Key West Harbor will not be navigable to such vessels. In the end, it is theorized that due to this constraint, the cruise ship industry will be forced to choose other ports of call, abandoning Key West, and destroying our local economy.
